Probate is the court-supervised process of gathering a deceased person’s assets and distributing them to creditors and inheritors. As an executor, your probate process will depend on the laws of California, which is a set of probate laws written by the California legislature. The goal is to make the probate process simpler and to give executors more flexibility in how they proceed.
First a probate petition is filed with the court, then the court appoints you as executor, if the deceased had a will or administrator, if no will.
Some of your duties include: Deciding if a will exists and is valid; Figuring out who are the decedent’s heirs or beneficiaries; Figuring out how much the decedent’s property is worth; Taking care of the decedent’s financial responsibilities; and Transferring the decedent’s property to the heirs or beneficiaries.
As executor, you’re in charge of keeping estate property safe during the probate process. You will prepare a list of the deceased person’s assets and, if necessary, get assets appraised.
When the creditor’s claim period has passed, you’ve paid debts and filed all necessary tax returns, if necessary, and any disputes have been settled, you’re ready to distribute all remaining property to the beneficiaries. The entire case can take between 9 months to 1 ½ years, maybe even longer.
